Regarding fixtures, suggest to a seller that the items they want to keep be removed and replaced prior to showing. This eliminates the situation in which a buyer sees the beautiful crystal chandelier in the dining room and resolves all issues regarding whether the buyer saw the item and assumed it would transfer. This situation can occur when “red Tagging” items. The tag may accidentally be removed, or the buyer may misunderstand the meaning of the tag and assume that he is getting an item the seller never intended to be sold as part of the transaction. Regarding personal property to be included in the sale, resolve the issue by including a list of the items in the offer to purchase. That way, there are no assumptions regarding whether something will or will not be included in the sale. In either case, an agent should recommend that everything be put in writing- this will allow an agent to more genuinely assist his client or customer should a dispute arise.
